Part A: Grass & Weeds  - (OR3-1962)

100.00 Regulates:
100.10 Regulates grass, weeds and other vegetation.
100.20 Requires the removal, trimming or cutting thereof by the owner or occupant of the premise where the same is growing under certain circumstances.
100.30 Removal, trimming or cutting by the Borough at the expense of such owner or occupant in default, and prescribing penalties for violation.
200.00 General:
200.10 No person, firm or corporation, owning or occupying any property within the Borough of Saegertown, shall permit any grass or weeds or any vegetation whatsoever, not edible or planted for some useful or ornamental purpose to grow or remain upon such premises so as to exceed a height of six (6) inches.
200.20 No person, firm or corporation shall permit any vegetation to throw off any unpleasant or noxious odor.
200.30 No person shall conceal any filthy deposit of vegetation.
200.40 No person shall allow vegetation to create or produce pollen.
200.50 Any grass, weeds or other vegetation growing upon any premises in the Borough in violation of any of the provisions of this section is hereby declared to be a nuisance and detrimental to health, safety, cleanliness and comfort of the inhabitants of the Borough.
200.60 The provisions of this section shall not apply to the owner or occupant of land used and operated for farm purposes.
300.00 Required Remedy:
300.10 Owner of any premises, as to vacant premises or premises occupied by the owner, and the occupant thereof, in case of premises occupied other than the owner, shall remove, trim or cut all grass, weeds or other vegetation growing or remaining on such premises in violation of section 200 of this ordinance.
400.00 Enforcement:
400.10 The Borough council, or any officer or employee of the Borough may be designated to enforce this ordinance.
400.20 Authorized enforcement is hereby authorized to give notice of violation by personal service or the United States Mail of violations of this ordinance.
400.30 Authorized enforcement shall direct and require such occupant to remove, trim or cut such grass, weeds or vegetation, so as to conform to the requirements of this ordinance.
400.40 Violators have five (5) days after issuance of such order to comply.
400.50 Failure to neglect, fail or refuse to comply with said notice, within the period stated, the Borough may remove, trim, or cut such grass, weeds or vegetation.
400.60 Cost of removing, trimming or cutting of said vegetation may be collected by the Borough from such person, firm or corporation as provided by law, at a rate set by resolution of Council.
500.00 Penalties:
500.10 Any person, firm or corporation who or which shall violate or fail, neglect or refuse to comply with any provisions of this ordinance, shall upon conviction thereof pay a Class E fine as set by resolution of Council plus costs of prosecution.
500.20 Each day’s violation shall constitute a separate offense and notice to the offender shall not be necessary in order to constitute an offense.
