Part B: Railroad Agreement  - (OR1-1912)

100.00 Right to Lay Tracks:
100.10 The NYPANO Railroad Company shall have the right to lay four tracts across the streets of the Borough of Saegertown, Crawford County Penna., on the line of its right of way together with such sidings as may from time to time be deemed necessary by said Company.
100.20 Said tracks and sidings to be above grade with a clearance of not less than fourteen (14) feet.
   
200.00 Road Clearance:
200.10 That said NYPANO Railroad Company shall have the approval to raise its present tracks and sidings and lay its new tracks and sidings at such a grade through said Borough as it may consider necessary for the purpose of carrying on its business;
200.11 Provided that all bridges carrying said tracks across said streets shall be constructed to bear a clearance of not less than fourteen (14) feet between the undermost girders as of beans and the grade of the street.
   
300.00 South Street Clearance:
300.10 That the NYPANO Railroad Company is hereby permitted to lower the surface of South Street at its crossing thereof about one (1) foot;
300.11 Provided the said NYPANO Railroad Company shall make proper and suitable approaches to the place so lowered.
   
400.00 Erie Street Clearance:
400.10 The said NYPANO Railroad Company is hereby permitted to lower the surface of Erie Street at its crossing thereof about four (4) feet;
400.11 Provided said NYPANO Railroad shall make easy, proper and suitable approaches to the place so lowered;
400.12 The grade of the approach from the west to be about two (2) percent per one hundred (100) feet,
400.13 The grade of the approach from the east to be about two and eight tenths (2.8) per cent per one hundred (100) feet.
   
500.00 South Street Bridge:
500.10 The said NYPANO Railroad Company shall have the right and hereby is permitted to erect and construct a bridge across said South Street on the line of its right-of- way with uniform space of fifty (50) feet from the face of the east abutment to the face of the face of the west abutment,
500.20 A clearance of fourteen (14) feet from the grade of street lowered as aforesaid, to the underside of the bridge girders of beams, the center of said fifty (50) foot span to be over the center of said street.
500.30 Said bridge to be used to carry NYPANO Railroad Company for the purpose of carrying its tracks, sidings and such other uses as may be necessary.
   
600.00 Erie Street Bridge:
600.10 The said NYPANO Railroad Company shall have the right and herby is permitted to erect and construct a bridge across said Erie Street on the line if its right-of- way, with a span of fifty (50) feet from the face of the west abutment;
600.20 With a clearance of fourteen (14) feet from the grade of said street lowered as aforesaid, to underside of bridge girders of beams, the center of said fifty (50) feet span to be over the center of said street.
600.30 Said bridge to be used by said NYPANO Railroad Company for the purpose of carrying its tracks, sidings and such other uses as may be necessary.
   
700.00 Wing (Retaining) Walls:
700.10 The said NYPANO Railroad Company shall construct and place, and shall maintain and keep in repair, brick, stone or cement wing walls at each end of and in a straight line with the face of the abutment of all bridges,
700.20 The walls shall be sufficiently long and high to prevent the filling from falling or flowing over onto the sidewalk or street.
   
800.00 Paving Streets:
800.10 The said NYPANO Railroad Company shall pave all streets with first class paving, in good substantial manner, between the abutments of said bridges, the width of the bridges.
   
900.00 Enclosure of Bridges:
900.10 The said NYPANO Railroad Company shall firmly and completely enclose all bridges so as to prevent the dropping through to the street below, of any dirt, cinders, ashes, slag or other matter from the tracts, sidings, and trains or otherwise.
   
1000.00 Road Drainage:
1000.10 The said NYPANO Railroad Company shall and her y is required to furnish a good and sufficient drainage for the surface of said streets at the said bridge crossings.
   
1100.00 Cost of Ordinance:
1100.10 All expenses and cost in accrued to passage, publishing, posting, and recording of this ordinance shall be paid by said NYPANO Railroad Company.
